What's happening in Ukraine is a mass, indiscriminate murder of civilians; also the destruction of property with no military significance.
As horrible as that is, it falls short of genocide: the attempt to kill a population in its entirety. The Nazis, for example, succeeded on killing 90% of European Jewry in the attempt to kill them all.
There is no profit in exagerating mass murder by describing it as 'genocide'. To the contrary, it undermines the validity of the accusation, so, before a judge, the guilty may claim innocence on the basis of their intentions and pointing to the portion of survivors.
It would be an example of gross injustice, if the guilty escaped on a technicality.
